I undertake to repatriate the private car from China within such period as stipulated by the China Customs, and return the Carnet to the Hong Kong General Chamber of Commerce (“The Chamber”) within 14 days upon completion of the trip.
If the car is not re-exported from China within such period, I accept full responsibility for any negotiations or proceedings with the China and Hong Kong Customs directly or indirectly. I agree to pay all duties, taxes and other charges arising from any additional Customs’ requirements or failure to observe Customs regulations and conditions in both the Mainland China and Hong Kong, as well as all legal, administrative and/or other costs and expenses on a full indemnity basis in the recovery of all or any amounts paid by the Chamber under this Carnet and/or in enforcing the security guarantee referred to below.
I agree to permit the Chamber to withhold the above cash deposit or guarantee (“security”) for up to a period of 31 months from the date of issue of the Carnet, if the car is stolen in or not re-exported from China, the original Carnet documents are partially or totally lost, or any omissions or discrepancies are found on the returned Carnet documents. The security will be returned to the Carnet Holder (“Holder”) on a non-interest bearing basis upon the expiry of such period, provided that the Chamber receives no customs claims within the said 31-month period.
I agree that, if there is customs claim, the security will be withheld until the claim is completely settled between the Holder and Customs. The security may be used to reimburse the Chamber for any duties, taxes, customs charges, all other costs and expenses incurred as above-mentioned, and/or any fees charged by the Chamber for regularization actions.
I understand and agree that a Carnet issued by the Chamber is not in itself an endorsement of the Holder’s submitted information, nor a guarantee of acceptance by the Customs authorities. Customs authorities have the absolute right to reject or revoke any Carnets without giving any explanations. The Chamber is not liable to any claims under all circumstances on the usage of this Carnet in or outside Hong Kong.

All information collected on this form is used for this application only.
All application fees must be paid once the ATA Carnet is approved.

The Chamber reserves the right to issue or refuse to issue a Carnet. If an applicant withdraws its application for whatever reasons, fees paid to the Chamber are not refundable.
